Welcome to the Diena Journal privacy policy. This document covers details about how your personal data is handled on the https://app.diena.co website (“Website”) and in the Diena Journal mobile applications (“App”). You will also read about your rights and what you can ask us to do with your personal data.
Diena Journal is a platform that lets you create memories on your personal timeline. By default, everything stays on your device. When you create a Diena Journal account, you get access to Online Features. Online features include:
Personal data is collected, processed and secured in compliance with the General Data Protection Regulation (GDPR). The sole trader Lucas Pluvinage EI (“We”) is the controller of the personal data we process about you in relation to the use of our Website and App. Lucas Pluvinage EI’s postal address is Bureau 326, 59 Rue de Ponthieu, 75008 PARIS.
When you register for an account we require some information about yourself:
You can also use your Google or Apple account to register. If you do so, we may gain access to public profile information such as your name, e-mail address and Apple, Facebook or Google ID.
We process this data as it is necessary to deliver the Diena Journal Online Features to you (legal basis: the performance of the agreement).
With a Diena Journal Account, you can synchronise your memories. By default, memories are only available to you. They become shared once you invite, either in-app or via a private Web link, other Diena Journal users to join, either as a Participant or as a Viewer. A Participant can edit the content of the memory. A Viewer can only view the content and write comments.

Note that even if the App asks to access your personal gallery, the content and any derived metadata stays on your device.
Content can be deleted using the app. If you delete your account, the associated content associated to memories where you are the sole Participant will be deleted. For memories which have multiple participants, content that you uploaded remain on the platform. You can delete this content manually before deleting your account.
If you decide not to have an account, you can still use the app by creating local memories. Any content you add in local memories will not be processed by the Diena Journal Online Platform.

The legal basis for this processing is our legitimate interest to improve the App, by analyzing how the App is used, what problems are encountered and what improvements are necessary.
We have never sold your personal data to third parties for commercial purposes, and we have no intentions to do so in the future. We only share your personal data when necessary to provide our services, as described here.
We provide personal data to third parties who process personal data on our behalf. We enter into a processing agreement with our processors in which we legally bind our processors to process your personal data in accordance with the GDPR. We share data, for instance, with:
Your personal data will only be stored or processed outside the European Economic Area (EEA) by us or by third parties if this is in accordance with the applicable laws and regulations on the transfer of personal data to countries outside the EEA. This means that we will only transfer your personal data to countries outside the EEA if the European Commission has decided that the third country in question ensures an adequate level of protection (has taken an adequacy decision), or if other appropriate safeguards are put in place, such as the use of unmodified Standard Contractual Clauses that have been approved by the European Commission.
We retain your personal data only as long as necessary for the purposes described in this policy:
Account data (display name, email, avatar): retained for the duration of your account. Deleted within 30 days of account deletion. Memories and associated content: retained for the duration of your account. If you are the sole Participant of a memory, it is deleted when you delete your account or the memory itself. For shared memories with multiple Participants, content you uploaded remains until you delete it manually or until all Participants delete their accounts. Usage and analytics data: retained for a maximum of 13 months from collection, after which it is aggregated or deleted. Crash and diagnostic data: retained for 90 days from collection.
You personal information can be changed in your account settings. Any synchronized memory can be deleted if you are the sole Participant of this memory. When a memory deleted, all stored content in that memory is also deleted. You can delete your account using the account settings screen in the App.
You have the right to access, correction or erasure of your data. You can also ask us to restrict the processing or transfer your personal data and you have the right to object to the processing of your personal data.
